First seditionist to breach the Capitol on 1/6 sentenced

The Supreme Court’s Republicans got his sentence reduced but couldn’t get him off the hook altogether (at least not yet):
The first rioter to breach the U.S. Capitol during the Jan. 6 attack was sentenced Tuesday to more than four years in prison.
The big picture: Michael Sparks, a Kentucky man who railed against the 2020 presidential election results and advocated for violence online months before the day of the attack, was sentenced to 53 months in federal prison.
The intrigue: Prosecutors in Sparks’ case dropped the obstruction charge against him — one that the Justice Department had relied on in more than 300 Jan. 6 cases (Trump’s included) — ahead of sentencing.
That move followed the Supreme Court’s June ruling that prosecutors must show a defendant interfered with documents, records or other material parts of an official proceeding to prove an obstruction charge, punting the central case back to a lower court.
But Judge Timothy Kelly, a Trump appointee, said he would still take into account the conduct presented at trial, contending it was clear Sparks wanted to obstruct the counting of votes, NBC reported.
Flashback: Sparks was convicted by a jury in March of all six charges he faced, including felony obstruction of an official proceeding, civil disorder and multiple misdemeanor offenses.
Also someone will be pardoned, possibly before 6PM on January 20, if Trump wins, one of the countless reasons to hope the liberal beats the fascist.
