Alabama was allowed to execute a prisoner early this morning even though its previous two state murders had involved torturing prisoners to death. Sotomayor dissented on behalf of the Court’s three non-neoconfederate memebers:

I strongly recommend reading the entire dissent, which recounts with depressing detail what the Supreme Court and the 11th Circuit are allowing. This slow-motion dissolving of the Eighth Amendment is surely one of the gimmest parts of the Court’s unreasoned shadow docket.
