Texas assures court that people seeking abortions are merely being rained on
The sheer volume of bad faith packing into the construction, application, and legal defense of the Fugitive Uterus Act is staggering:
In its latest SCOTUS filing, Texas appears to argue that its ban on abortion after ~6 weeks is… not actually a ban on abortion after ~6 weeks? https://t.co/1WKGDNP72R pic.twitter.com/qvarrsZD4r— Maggie Astor (@MaggieAstor) October 21, 2021
As I wrote in my analysis of the law last month, SB 8 actually explicitly seeks to prevent people from defending themselves under the undue burden standard. https://t.co/QoCGFyyidJ— Maggie Astor (@MaggieAstor) October 21, 2021
If America had serious courts of law this would all be moot already, but instead the law is still in force because the 5CA and the Supreme Court are dominated by people for whom bad faith is a lifestyle choice.
