The Cult of the Court
I had extremely low expectations for the Biden commission on the federal judiciary, but initial reports would seem to indicate that they weren’t low enough:
The Biden commission on SCOTUS reform has released a long interim document in advance of its final report.
Here's its bottom line on proposals to expand the Court: a balanced Court is (1) overrated; and (2) may "reinforce the notion that the Justices are partisan actors." pic.twitter.com/reSZxT1fM9— Steven Mazie (@stevenmazie) October 14, 2021
The Biden Supreme Court commission's talking points doc does a lot of hand-wringing about what will happen to perceptions of the Court's independence "if judges are perceived to be 'playing on the team' of one party or another," and can I just say: lol pic.twitter.com/QzbRE3kAnu— Jay Willis (@jaywillis) October 15, 2021
“Some people say that the Court is partisan and is imposing the will of the faction that has lost the popular vote in 7 or the last 8 presidential elections on the majority, some people like that the Court is imposing the will of the minority faction on the majority and would prefer this not to be called ‘partisan’, and who’s to say who’s right?” Elite Lawyer Brain is a hell of a drug.
