Here’s a sportsball analogy for everyone not up on the intricacies of administrative law.
Suppose an arbitrator ruled that replay review in the NFL or VAR in the other football required an hour-long appellate process before a three-person panel before a call could be overturned. What that would mean as a practical matter is that you couldn’t really have a replay system. Except the replay system here is the modern administrative state.
