Neither Donald Trump nor his lawyers know what he’s being charged with tomorrow
Amazing thread here from Teri Kanfield (thanks to commenter Sarah for flagging it).
The gist of it is that 99.99% of the time, somebody in Trump’s position, or at least that person’s lawyers, knows what the charges in the indictment are prior to the defendant’s arraignment, because prosecutors lay them out to the defense lawyers in the negotiations that precede the arraignment itself.
Prosecutors aren’t legally required to do this: it’s a mutually beneficial courtesy the prosecution offers the defense, as the prosecution doesn’t want to bring charges that may have to be dropped for some reason the prosecutors aren’t yet aware of, and of course the defense wants/needs to know what the charges are in order to advise the client going forward.
What apparently happened here is that Trump’s insane ranting about the prosecution — I hope his lawyers got paid up front — convinced Bragg to drop the usual niceties, meaning Trump and his lawyers will learn what he’s being charged with at the same time as everybody else outside DANY itself!
This, as Kanefield notes, is basically unprecedented, but of course the unprecedented is our boy’s speciality, along with grifting, whoring, cheating at real estate and golf, consuming mass quantities of hambenders, etc.
