Republicans hopes hack judges will block access to mifepristone
In addition to the inevitable effort restrict access to contraception, Republicans are going to try to use their lawless allies in the judiciary to try to restrict access to abortion medication:
A group of anti-abortion organizations sued HHS and the FDA on Friday in a bid to reverse the FDA’s approval of the abortion medication mifepristone.
Lawyers from the conservative Christian legal group Alliance Defending Freedom filed the suit in U.S. District Court for the Northern District of Texas in Amarillo on behalf of the Alliance for Hippocratic Medicine, the American Association of Pro-Life Obstetricians and Gynecologists, the American College of Pediatricians, the Christian Medical & Dental Associations and four doctors.
The FDA declined to comment on the litigation. An HHS spokesperson defended the medication as safe and effective and said that “denying women access to any essential care they need is downright dangerous and extreme.”
Needless to say, the argument is some kind of bullshit non-delegation claim, which is going to be a core strategy to usurp congressional and executive prerogatives going forward.
The other thing going on here is the increasingly abusive venue shopping:
Just to be clear on what this means, Alliance Defending Freedom is asking a hand-picked, Trump-appointed district judge in Amarillo to effectively block legal access to Mifepristone on a nationwide basis.
