Texas continues to vindicate Critical Legal Studies
Compare and contrast:
On the left is the opening of a complaint filed by DOJ lawyers. It describes DOJ’s understanding of the law in careful, lawyerly terms,
On the right is the opening of a complaint in a similar case written by Texas’s lawyers. I’ll let the tone of that paragraph speak for itself. pic.twitter.com/XMprmAmzEh— Ian Millhiser (@imillhiser) August 2, 2022
One thing the Texas complaint makes clear is that they think the venue-shopped District Court judge and the 5CA and Bart O’Kavanaugh will all be as or more receptive to a drooling Tucker Carlson monologue than something that at least takes the form of a legal argument. And, of course, they’re right!
You also may not be surprised to learn that when Republican Attorneys General actually have to make claims before judges, they openly admit that their laws are designed to stop abortions in virtually all circumstances, notwithstanding the reassuring noises being made by the anti-abortion movement elsewhere.
