GOP Harris County suit tossed for lack of standing
They’ll do a lot of things but they won’t do that:
When you see stuff like this, a couple of things are generally going on:
(1) Legal formalism isn’t completely empty to these guys. They do (sometimes) believe in some limits on pure power politics masquerading as law.
(2) The extent to which they believe that is strongly influenced by how important the ruling is likely to be — so in the case of something like Bush v. Gore, the belief in formal constraints disappears completely.
(3) As they say in Texas, you got know when to walk away, and know when to run.
