My take on what’s going on: Guys like Calabresi are political hacks who are also deeply invested in the belief that they are devoted to The Rule of Law.
The way this works is that when a politician starts looking like a bad bet, they suddenly become all principled and stuff, without noticing the practical convenience of their conversion.
To echo Thurman Arnold, this is called having “a legal mind.”
