More on this Monday, but with the midterms safely over and the open enrollment period nearly over, early on a Friday evening Judge Reed O’Connor (R-Tex) has as expected issued his ridiculously hacktacular opinion arguing that because Congress repealed the tax penalty enforcing the mandate the entire Affordable Care Act is unconstitutional. Assuming Ginsburg and Breyer stay alive, this probably will be reversed by the Supreme Court — but given that it was the tax penalty that according to Roberts made the ACA constitutional I wouldn’t bet anything I couldn’t afford to lose on it.
