What Are Some Avoidable Deaths Between Friends?
By Shorter Jonathan Adler: A case whose result would cause millions of people to lose health insurance coverage, with the substantial amount of pain and suffering that would ensure, hardly seems important enough for en banc review. In making this argument, I’m just thinking of the good the states; it’s not because I know that my hackish argument has absolutely no chance of convincing anyone who doesn’t share my fanatical opposition to the Affordable Care Act on policy grounds.
