The California Prison Disaster
When terrible bipartisan “tough on crime” policies meet terrible Republican tax policies, the results are awful for human rights.
As I say in the piece, judicial intervention is particularly justified here because it forces the political system to actually justify its priorities. If you really think that it’s of immense importance to public safety to keep 75-year-old golf club thieves off the streets, then pay for it. If it’s not worth any tax increases, you can’t really think it’s important. But either way, the solution can’t be systematic violations of civil rights.
