How surprising! Samuel Alito–who in the public of his supporters mysteriously went from being a staunch reactionary to being a moderate liberals should happily support when he was nominated to the Supreme Court–turns out to be…a staunch conservative! If you click on the handy interactive chart here, you’ll note that he agrees with the most conservative justice on the Court (Clarence Thomas) 83% of the time in non-unanimous opinions, and the most liberal member of the court (John Paul Stevens) 13% of the time. While Kennedy, an actual moderate conservative, agreed with JPS 38% of the time. (You can see more detailed data in PDF form here.) So, in other words, Alito is a staunch conservative, as was perfectly obvious from his record.

In fairness, however, this data does not take into account the all-important is-he-nice-to-his grandmother? and does-he-like-baseball? metrics favored by the hapless Stuart Taylor (see also here), or the does-he-agree-with-James-Dobson-on-the-free-exercise-clause metric favored by Ann Althouse, so I suppose of you believed it in the first place the jury could still be out…
